F&P Decision Tree
Free fitness & propriety assessment tool for FCA-regulated firms
Determine whether a misconduct finding affects an individual's fitness and propriety under FCA FIT 2.2. Answer each question to reach an assessment outcome with recommended actions.
Has a conduct rule breach been found following an investigation?
This requires a completed investigation with factual findings, not just an allegation. The breach should be mapped to a specific COCON rule (Rule 1–6 or SC1–SC4).
About this tool
This decision tree helps compliance officers at small FCA-regulated firms assess whether a misconduct finding affects an individual's fitness and propriety under FCA FIT 2.2. It is particularly relevant for firms preparing for the PS25/23 non-financial misconduct deadline on 1 September 2026.
The FIT 2.2 assessment considers three main criteria: honesty, integrity, and reputation; competence and capability; and financial soundness. Non-financial misconduct primarily engages the honesty, integrity, and reputation limb.
This tool provides general guidance on the assessment process. The actual F&P determination is fact-specific and must be made by the firm based on the full evidence of the investigation. For the complete investigation process, use our NFM Investigation Checklist. To identify which conduct rules are relevant, use our COCON Conduct Rules Self-Assessment.
